MEATION - WHAT IS IT?

Meation is the share that belongs to each spouse regarding the assets that make up the couple's patrimony.

In practice, this means that if we add the meations of each member of the couple, the result will be the total of the common patrimony (real estate, vehicles, among others).

In marriage regimes where there are common assets (community of acquired property, general community, and atypical regimes), the meation of the couple's assets applies, meaning each member is entitled to 50% of the collective patrimony, as the law establishes that the spouses contributed half.

This means that the members of the couple do not have rights over each individual common asset, but rather rights over half of the total assets that make up the common patrimony.

What is the difference between a meier and an heir?

When we are faced with the existence of an inheritance, it is important, first of all, to make the distinction between a meier and an heir. The meier is the spouse married under a regime that grants them the right to half of the couple's patrimony. No other family member can be considered a meier.

An heir is someone legally recognized as having the right to the inheritance in full or in a quota of the deceased's patrimony, such as the spouse and children of the deceased.
