Frequently Asked Questions

We have gathered the answers to the most common questions about how auctions, bidding, registration and rights over assets work.

Rights Over Properties

What is a Hereditary Share?
It is the fraction or share of the inheritance to which the heir is entitled, that is, the part held by the owner of the inheritance. It is not full ownership. Between the moment of acceptance and the moment of partition, the heirs have a Hereditary Share, corresponding to their quota in the inheritance, whose part will be defined with the partition. Hereditary Shares are equivalent to the number of heirs. While the inheritance remains undivided, that is, an inheritance that, although accepted by the heirs, has not yet been partitioned, what the heirs are entitled to in the inheritance are not specific assets, but rather a hereditary share, that is, a part or percentage of the totality of assets, rights, and debts (assets and liabilities) that make up the inheritance.
Can I sell a Hereditary Share?
Yes, it is possible. It is important to know that when a Hereditary Share is sold or paid to strangers (that is, third parties who are not heirs), the other heirs (co-heirs) enjoy the right of preference under the terms in which that right applies to co-owners. The right of preference can be exercised within 2 months after the communication of the sale. In other words, when intending to sell the hereditary share, the heir must give preference to the co-heirs regarding their intention to sell, indicating for this purpose the terms of the transaction, namely the buyer's name, price, and payment conditions.
What is a Usufruct?
It is a right granted to someone who, for a certain period, can enjoy a thing belonging to another, whether real or personal property, that belongs to another person. This right protects the person who intends to transfer the ownership of an asset that is theirs to another person, but who wishes to continue to enjoy it while alive.
How long can a Usufruct last?
The declaration of usufruct may have a duration determined in the contract or may be for life, ceasing only upon the death of the usufructuary.
After the death of the usufructuary, do the heirs have the right to the property?
In the event of the usufructuary's death, heirs who are not included in the purchase and sale agreement, the donation, or the declaration of usufruct have no right to the property. Even if they are legal heirs, this specific asset cannot be considered part of the estate.
Where is it possible to grant a Right of Usufruct?
For the usufruct to be in compliance with legal requirements, a declaration of usufruct must be issued, duly signed by the parties and authenticated at any Notary Office or Land Registry, or by a lawyer or solicitor.
Is it possible to annul the grant of a Right of Usufruct?
Yes, it is possible. Either party can annul this condition, provided there is mutual agreement. In this case, both parties must formalize the change in this situation at a Notary Office or Land Registry. There are no taxes to be paid. However, it is necessary to pay the costs of the acts at the Notary Office or Land Registry, or to the lawyer or solicitor.
What happens if the owner decides to sell the property?
If the owner decides to sell the property, the right of usufruct remains in effect.
What are the Rights of the Life Tenant?
The Usufructuary must enjoy the following rights: • Rent out the property. When the right of usufruct is assigned, the owner cannot object to this rental. However, the lease agreement expires as soon as the landlord passes away. Under the law, the death of the usufructuary extinguishes the right of usufruct. Consequently, the lease agreement ceases to be valid. The owner may demand the return of the property 6 months after the death of the usufructuary; • Continue to reside in the property, even if it is sold. The buyer cannot occupy the house or “evict” the usufructuary. Although this may be a difficult transaction to realize, since the buyer cannot inhabit or derive income from the property, this possibility exists in the law; • Property usufruct can be a form of inheritance, even for those who are not legal heirs. The property owner can choose who will have the right to use the property and, eventually, have full and definitive possession of it; • Ease in executing a property usufruct contract.
What are the Duties of the Life Tenant?
The Usufructuary must fulfill the following duties: • Administer and care for the property as if it were their own. The property must be well maintained and, upon the end of the usufruct, it must not present damages that were not caused by normal use; • Pay expenses such as IMI and other charges; • Make necessary repairs for the maintenance and preservation of the property. In return, major repairs and improvements are the responsibility of the owner.
What is a Bare Ownership?
The asset belongs to a specific person, who does not have possession and use of it. Therefore, it implies ownership of the property, although it does not imply the right of usufruct, which will belong to the usufructuary, until their death or when the term determined for the usufruct ends.
Is it possible to sell a Bare Ownership?
Yes, it is possible. The owner has the power to transfer the bare ownership through a sale or donation, and the power to use it as collateral, for example, in a bank loan.
What are the Rights of the Bare Owner?
The Bare Owner must enjoy the following rights: • The Bare Owner has rights over the asset and can sell it, however, the buyer will only acquire the root of the property. In other words, the sale does not annul the existence of the right of usufruct, which only ceases with the death of the usufructuary or with the end of the term established for the duration of the usufruct.
What are the Duties of the Bare Owner?
The Bare Owner must fulfill the following duties: • Make necessary major repairs and improvements to the property. For example: ruptures of interior and exterior water and sewage pipes, construction defects and similar.
What is a Root?
The asset belongs to a specific person, who does not have possession and use of it. Therefore, it implies ownership of the property, although it does not imply the right of usufruct, which will belong to the usufructuary, until their death or when the term determined for the usufruct ends.
Is it possible to sell a Raiz?
Yes, it is possible. The owner has the power to transfer the bare ownership through a sale or donation, and the power to use it as collateral, for example, in a bank loan.
What are the Rights of the Owner of the Raiz of a property?
The Owner of the Bare Ownership of a property must enjoy the following rights: • The owner of the Bare Ownership has rights over the asset and can sell it; however, the buyer will only acquire the bare ownership of the property. In other words, the sale does not annul the existence of the right of usufruct, which only ceases with the death of the usufructuary or with the end of the term established for the duration of the usufruct.
What are the Duties of the Owner of the Raiz of a property?
The Owner of the Bare Ownership of a property must comply with the following duties: • Carry out necessary major repairs and improvements to the property. For example: ruptures in internal and external water and sewage pipes, construction defects, and similar issues.
What is a Surface Right?
This is a real right, granted by the owner to another party, on a permanent or temporary basis, to build a structure on a plot of land. In other words, it grants the perpetual or temporary faculty to build or maintain a work on another's land or to make or maintain plantations on it. Contrary to usufruct, which consists of the right to use another's thing, the right of superficies is a real right (of ownership) over the construction or plantation that is built (or planted) on the land. The Right of Superficies and the Right of Property of the landowner are distinct but interdependent legal realities. Since it is a real right, this superficies ownership can be alienated without the alienation of the land necessarily occurring. The holder of the Right of Superficies is called the superficies holder, while the owner of the land is called the landowner.
How and Where is the Surface Right Constituted?
The Right of Superficies is constituted by contract, will, or adverse possession, onerous or gratuitous. It may result from the alienation of pre-existing works or trees on the land, provided that it does not include the ownership of the land. The deed of the Right of Superficies can be executed at a Notary's Office or a Land Registry, or through a Private Document Authenticated by a solicitor.
How is the Surface Right Extinct?
In the document constituting the Right of Superficies, the two parties may stipulate the extinction of this right depending on the fulfillment of any condition or as a consequence of the destruction of the work or the trees. In addition, the right of superficies also extinguishes: • If the superficies holder does not complete the work or proceed with the plantation within the fixed term or, in the absence of a fixed term, within a term of ten years; • Once the work or trees are destroyed, if the superficies holder does not rebuild the work or renew the plantation within the same terms from the date of destruction; • When constituted for a fixed term and the term has expired; • By the merger, in the same person, of the right of superficies and the right of property; • By the disappearance or uselessness of the land; • By expropriation for public utility.
What are the Rights of the Surface Rights Holder?
The Superficies Holder must enjoy the following rights: • Use the surface of the land of the landowner in accordance with the terms of the signed contract; • Enjoy and dispose of the superficies construction or plantation as their own thing, separate from the ownership of the land; • Exercise the right of preference in the acquisition of the land.
What are the Duties of the Surface Rights Holder?
The Superficies Holder must comply with the following duties: • Pay the landowner the consideration agreed upon contractually between both parties; • Build, erect, or plant in accordance with what is agreed in the contract and, if a work project has been carried out, respect the projects discussed in the contract; • Preserve the erected work and, in case of onerous alienation, must notify the landowner so that they can exercise the right of preference for the purchase.
What are the Rights of the Land Owner?
The Landowner must enjoy the following rights: • Receive from the superficies holder the consideration agreed upon contractually between both parties; • Before the start of the work or plantations, the use and enjoyment of the right of superficies of the land belongs to the landowner; therefore, this person can use the land until the work or plantation begins; • If there is an unused part of the land by the superficies holder, the landowner can continue their activity on the unused land, provided that such use is specified in the contract established between both parties; • The landowner can resort to the termination of the contract before its term if the superficies holder does not build or plant within the agreed time, or if they build or plant with a purpose different from that granted.
What are the Duties of the Land Owner?
The Landowner must comply with the following duties: • Not prevent or prejudice any activity or realization of the exercise rights of the superficies holder; • Ensure the quality of the land and its suitability for the contracted use and purpose; • Give preference to the superficies holder for the acquisition of the land in case of sale for valuable consideration.
What is a Meação?
Meação is the share that belongs to each spouse over the assets that make up the couple's patrimony. In practice, this means that if we add the meação of each member of the couple, the result will be the total common patrimony (real estate, vehicles, among others). In marriage regimes where there are common assets (community of acquired property, general community, and atypical regimes), the meação of the couple's assets applies, meaning each member has the right to 50% of the collective patrimony, since the law establishes that the spouses contributed half. This means that the members of the couple do not have rights over each of the common assets, but rather rights over half of the total of the assets that make up the common patrimony.
What is the Difference between a Meeiro and an Heir?
When we are faced with the existence of an inheritance, it is important, first of all, to make the distinction between a meirante (spouse with a share) and an heir. The meirante is the spouse married under a regime that grants them the right to half of the couple's patrimony. No other family member can be considered a meirante. An heir is someone legally recognized as having the right to the inheritance in full or in a quota of the deceased's patrimony, such as the spouse and children of the deceased.
What is a Proportion?
The asset for sale does not constitute full ownership, only a part, that is, a proportion of it. Common ownership or co-ownership exists when two or more people are simultaneously holders of the right of property over the same asset.
Do All Co-owners Possess the Same Percentage/Share of the Asset?
An asset can have two (or more) owners, but these do not have to be owners in equal percentages. One of them may be the owner of 66.66% (or a fraction of 2/3) of a property and the other owner of only 33.33% (a fraction of 1/3) of the same property, for example.
What are the Rights of the Co-owners?
The co-owners exercise, jointly, all the same rights that belong to the singular owner. In addition, any of the co-owners can enjoy the asset.
What are the duties of co-owners?

Assets

On average, what is the relationship between the minimum bid amount and the asset's appraised value?
Are the assets sold free of liens and encumbrances?
Sim, sempre.
What is the condition of the assets presented at auction?
Can I bid on assets without having visited them beforehand?
Is it possible to visit the real estate and movable assets to be auctioned before the auction ends?
Sim.
Are the assets sold individually or as a bundle?
Who owns the assets presented at auction?
How can I obtain information about the assets at auction?
Do the properties have all the documentation required by law?
Do the assets for sale have a warranty?
